Michael B. Doherty

Michael B. Doherty was born in Springfield, Massachusetts in 1976.  He was awarded a B.A. from Boston College (1998) and a J.D. from Georgetown University Law Center (2001).  He was admitted to the practice of law in Massachusetts in January 2002, and has since been admitted to the practice of law in Rhode Island, New Hampshire and Connecticut, various federal district courts and the First Circuit Court of Appeals.  Attorney Doherty has appeared in federal and state courts throughout New England.  His litigation practice focuses primarily on appellate, business, construction, employment, products liability defense and professional liability defense litigation.  He also assists clients with employment counseling, including advising clients on applicable employment laws, drafting employment agreements and other documents, and helping clients avoid litigation.

Noteworthy Cases

Successfully briefed appeals for surety defendant in two mechanics lien cases brought by subcontractors arising from the same project.  Superior Mech. Plumbing & Heating, Inc. v. Ins. Co. of the West, 81 Mass. App. Ct. 584, review denied 462 Mass. 1110 (2012); Infra Metals Co. v. Jarosz Welding Co., 81 Mass. App. Ct. 1122 (2012).


In suit to recover money owed on commercial loan against company and guarantors, obtained dismissal of all but one counterclaim against bank client relating to a foreclosure sale, leading to the dismissal of the final counterclaim and all affirmative defenses two days later and obtaining the full amount owed plus attorneys' fees and expenses (just under $1 million) shortly thereafter.


Obtained partial dismissal and subsequent summary judgment for company and CEO on various claims by former employee related to severance allegedly due, including intentional interference with contract, fraud, civil conspiracy and violations of the Consumer Protection Act.


Represented real estate developer in various lawsuits, including $1.5 million+ breach of contract claim, arising from dissolution of partnership, with favorable results.

Product Liability:

Second chaired a defense verdict for boiler manufacturer in $800,000+ product liability trial in federal court.

Professional Liability:

Obtained dismissal in legal malpractice case for defendant attorney who covered real estate closing where title documents were allegedly negligently drafted.
